Bidder Registration Terms & Conditions

These Registration Terms & Conditions ("Registration Terms") govern the creation and use of your bidder account on the Bird's Nest Auctions website. By clicking "I Agree" during registration, you confirm that you have read, understood, and agreed to these terms.
1. Eligibility Requirements
To create a bidder account with Bird's Nest Auctions, you must meet all of the following requirements at the time of registration and on an ongoing basis:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding contract
- You are not currently suspended or banned from bidding with Bird's Nest Auctions
- All information you provide during registration is accurate, current, and complete
We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these requirements.
2. Account Information & Accuracy
What We Collect at Registration
When you create an account, you will be asked to provide the following:
- Full legal name
- Valid email address
- Phone number
- Billing address
- Credit or debit card information (required for bidding)
This information is used to manage your account, process payments, and communicate with you about auctions and pickups. We do not sell your personal data to third parties.

Your Responsibility to Keep Information Current
You are responsible for keeping all account information accurate and up to date. If your contact information, address, or payment method changes, please update your account promptly.
Bird's Nest Auctions is not responsible for missed communications or failed payments resulting from outdated account information.
3. Credit Card Requirement
A valid credit or debit card must be on file to activate your bidding account. Your card will not be charged at registration, but it serves as your payment method for any items you win.
Your card may be pre-authorized for $1 to confirm that the card is active, however this is only a temporary authorization.
By providing your card information, you authorize Bird's Nest Auctions to charge your card for:
- The final bid price plus buyer's premium for any items you win
- Applicable sales tax
If your card is declined and payment is not received within our payment window (24 hours from the auction close), your account may be suspended and the item may be resold.
4. One Account Per Person
Each person may only hold one active bidder account.
Creating multiple accounts to circumvent a suspension, increase bidding power, or manipulate auction outcomes is strictly prohibited and will result in permanent banning of all associated accounts.
Accounts are personal and non-transferable. You may not allow another person to bid using your account. You are fully responsible for all activity that occurs under your login credentials.
5. Username & Password
Username
To keep things simple, your username is the email address you provided at registration.
Keeping Your Account Secure
You are responsible for maintaining the security and confidentiality of your password. Please choose a strong, unique password and do not share it with anyone.

Bird's Nest Auctions is not liable for any loss or damage arising from unauthorized use of your account due to your failure to protect your login credentials.
6. Consent to Communications
By registering, you agree to receive the following types of communications from Bird's Nest Auctions:
- Transactional emails: account confirmation, bid notifications, invoices, and pickup reminders (these cannot be opted out of as they are required for your account to function)
- Marketing emails: upcoming auction announcements, newsletters, and promotional offers (you may opt out of these at any time by clicking "Unsubscribe" in any marketing email)
- Text messages: pickup reminders or urgent account notices, if you provide a mobile number and opt in
We will never sell your contact information or use it for any purpose unrelated to Bird's Nest Auctions' operations.
7. Acceptable Use of Your Account
You Agree To:
- Use your account only for lawful purposes
- Bid in good faith with genuine intent to purchase
- Honor all winning bids by completing payment and pickup
- Treat Bird's Nest Auctions staff and other bidders with respect
Unacceptable Account Use:
- Place bids you have no intention of honoring
- Engage in shill bidding, bid manipulation, or collusion with other bidders
- Use automated tools, bots, or scripts to place bids
- Attempt to gain unauthorized access to other accounts or our system
- Misrepresent your identity or provide false information
- Use our platform for any commercial purpose without our prior written consent
Violation of any of the above may result in immediate account suspension or permanent ban, and may be reported to appropriate authorities.
8. Account Suspension & Termination
When We May Suspend or Terminate Your Account
Bird's Nest Auctions reserves the right to suspend or permanently terminate your account at our discretion for any of the following reasons:
- Failure to pay for winning bids
- Failure to pick up purchased items
- Providing false or misleading registration information
- Engaging in prohibited bidding conduct
- Disruptive, threatening, or abusive behavior toward our staff or other bidders
- Any other violation of these Registration Terms or our Terms of Use
What Happens When Your Account Is Closed
If your account is suspended or terminated, you will lose access to your bidding history and any active bids will be cancelled.
You remain responsible for payment of any items you won prior to suspension. We are not obligated to restore suspended accounts.
Closing Your Own Account
If you'd like to close your account voluntarily, please contact us at help@birdsnestauctions.com.
Please note that you must fulfill all outstanding payment and pickup obligations before your account can be closed.
9. Privacy & Data Use
Your privacy matters to us. The personal information you provide at registration is used exclusively to operate your account, process transactions, communicate with you, and improve our services.
We use industry-standard security practices to protect your data.

10. Minors & Parental Responsibility
Our platform is intended for users who are 18 years of age or older.
If we discover that a minor has registered for an account, that account will be immediately deactivated.
If you are a parent or guardian and believe a minor has registered using your information, please contact us at help@birdsnestauctions.com.
Bird's Nest Auctions takes no responsibility for any charges incurred by a minor who gained access to a registered adult's account.
11. Changes to These Terms
We may update these Registration Terms from time to time.
When we do, we'll post the updated version on our website and update the "Last Updated" date at the top.
For significant changes, we'll notify registered bidders by email.
Your continued use of your account after changes are posted constitutes your acceptance of the updated terms.
If you do not agree to updated terms, you may close your account at any time by contacting us.
12. Governing Law
These Registration Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of law provisions.
Any disputes arising out of or related to your account or these terms shall be resolved in Rockingham County, New Hampshire.
